These Terms of Use ("Terms") govern your access to and use of our website, mobile application, digital platforms, educational resources, products, services, and community spaces operated by The Nurturing Nest.

By accessing our website, downloading or using our mobile application, registering for any of our programs, purchasing any of our products or services, or participating in any of our online or offline activities, you agree to be bound by these Terms.

If you are registering on behalf of a child, you confirm that you are the child's parent or legal guardian and that you have the authority to accept these Terms on the child's behalf.

If you are accepting these Terms on behalf of an organisation, school, institution, or other entity, you represent that you have the authority to bind that entity to these Terms.

We may update these Terms from time to time to reflect changes in our services, technology, business practices, or legal requirements. The latest version will always be published on our website with the updated effective date. Your continued use of our services after such updates constitutes your acceptance of the revised Terms.

3. About The Nurturing Nest

The Nurturing Nest is an education and coaching business founded by Sheekha Rathi. We support parents—particularly mothers—in developing greater awareness, emotional well-being, connection, and confidence in family life.

We provide educational and coaching experiences through online and offline programs, digital platforms, community spaces, recorded resources, and events. Further details about the Services are set out in Section 6.

4. Definitions

For the purposes of these Terms, the following definitions shall apply:

"The Nurturing Nest", "we", "our", or "us"

means the education and coaching business founded and operated by Sheekha Rathi under the brand name The Nurturing Nest. Where the context requires, references to our team may include authorised employees, facilitators, contractors, and service providers acting on our behalf.

"Services"

means all products, programs, coaching, workshops, webinars, memberships, retreats, recorded courses, certifications, digital resources, mobile application, website, community platforms, downloadable materials, educational content, and any current or future services provided by The Nurturing Nest.

"Participant", "User", or "You"

means any individual who accesses, purchases, registers for, participates in, or otherwise uses any Service offered by The Nurturing Nest.

"Content"

means videos, audio recordings, course materials, worksheets, PDFs, journals, presentations, templates, graphics, meditation recordings, EFT routines, assessments, activities, frameworks, methodologies, program structures, downloads, website material, mobile application material, and other educational or creative material owned by, created for, or lawfully licensed to The Nurturing Nest.

"Community"

means any online or offline learning space operated by The Nurturing Nest, including memberships, WhatsApp groups, discussion forums, workshops, retreats, coaching groups, live events, and similar community environments.

5. Eligibility

By accessing or using our services, you represent and warrant that:

If you are registering a child for any workshop, retreat, coaching program, event, or activity offered by The Nurturing Nest, you confirm that you are the child's parent or legal guardian, or that you have obtained the necessary authorization to register the child.

Parents and guardians remain responsible for the child's participation, behaviour, safety requirements, and the accuracy of any information provided during registration.

The Nurturing Nest reserves the right to refuse registration, participation, or access to any service where we reasonably believe these eligibility requirements have not been met.

6. Our Services

The Nurturing Nest provides educational, coaching, and personal development services designed to support parents, families, and individuals in their growth and learning journey.

Our services may include, but are not limited to:

  • Live webinars

  • Online workshops

  • Offline workshops

  • Individual coaching

  • Group coaching programs

  • Parent and family coaching

  • Membership and community programs

  • Recorded courses

  • Mobile application-based learning

  • Digital downloads, workbooks, journals, and educational resources

  • Parent and child retreats

  • Certification programs

  • Live events

  • Educational content published through our website, mobile application, or official communication channels

The availability, format, duration, pricing, features, and content of any service may change from time to time.

We reserve the right to:

  • introduce new services;

  • modify existing services;

  • discontinue any service;

  • update course content;

  • revise learning materials;

  • change facilitators or instructors;

  • modify schedules;

  • improve or replace features within our website or mobile application,

where reasonably necessary to improve the quality, safety, or effectiveness of our services.

Where practical, we will make reasonable efforts to notify participants of significant changes that may affect an ongoing program.

Nothing in these Terms guarantees that any particular service, feature, instructor, coach, digital resource, or program will remain available indefinitely.

7. Registration and User Accounts

Certain services offered by The Nurturing Nest may require you to register, create an account, or provide personal information.

Depending on the service, registration may take place through:

  • Our mobile application

  • TagMango

  • Other trusted third-party platforms approved by The Nurturing Nest

You agree to provide accurate, complete, and current information during registration and to update your information whenever reasonably necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account.

You agree not to:

  • share your login credentials with another person;

  • allow multiple individuals to access services purchased under a single account unless expressly permitted;

  • impersonate another person;

  • create accounts using false information;

  • attempt to gain unauthorized access to another user's account.

If you believe your account has been accessed without authorization, you should notify us as soon as reasonably possible.

The Nurturing Nest reserves the right to suspend, restrict, or terminate accounts where we reasonably believe that:

  • false information has been provided;

  • these Terms have been violated;

  • unauthorized account sharing has occurred;

  • fraudulent, unlawful, or abusive activity has taken place; or

  • continued access could negatively affect our services or community.

Where appropriate, we may request additional information to verify your identity before restoring access to your account.

8. Third-Party Platforms and Services

Certain Services are hosted, delivered, supported, or processed through third-party platforms, including course-hosting services, mobile applications, video-conferencing tools, messaging services, payment providers, and cloud infrastructure.

Your use of a third-party platform may also be governed by that provider’s own terms, privacy policy, technical requirements, and account rules.

While we select service providers with reasonable care, we do not control their systems and cannot guarantee that every third-party platform will remain continuously available, error-free, or unchanged.

Where a material third-party interruption affects an ongoing Service, we will make reasonable efforts to communicate available alternatives.

We are not responsible for the independent policies, practices, security, availability, or functionality of third-party platforms.

9. Payments

The fees for our products and services are displayed at the time of registration or purchase through our website, mobile application, or authorized third-party platforms.

By purchasing any product or service offered by The Nurturing Nest, you agree to pay all applicable fees associated with your selected program, product, or service.

Payments may be processed through trusted third-party payment providers. The Nurturing Nest does not collect or store your complete payment card information, banking credentials, or other sensitive payment authentication details.

You are responsible for ensuring that:

  • Your payment information is accurate and valid.

  • You are authorized to use the selected payment method.

  • Sufficient funds are available to complete the transaction.

Unless otherwise expressly stated, all prices are quoted in the applicable currency displayed at the time of purchase and are exclusive of taxes, duties, or charges where applicable.

The Nurturing Nest reserves the right to:

  • update pricing;

  • introduce promotional offers;

  • withdraw promotional offers;

  • revise payment structures;

  • introduce installment or subscription payment options; and

  • correct genuine pricing or typographical errors.

Any pricing changes will not affect purchases that have already been successfully completed.

Where a payment fails or remains incomplete, your registration or access to the relevant service may be delayed, suspended, or cancelled until the payment has been successfully received.

10. Refunds and Cancellations

Refunds, cancellations, transfers, and rescheduling of our products and services are governed by our Refund & Cancellation Policy, which forms an integral part of these Terms.

By purchasing any of our services, you acknowledge that you have read and agreed to our Refund & Cancellation Policy.

Unless expressly stated otherwise in writing:

  • registrations are non-transferable unless approved by The Nurturing Nest;

  • refunds are processed only in accordance with our published Refund & Cancellation Policy;

  • cancellation of participation does not automatically entitle a participant to a refund;

  • failure to attend a scheduled session, webinar, workshop, retreat, or coaching appointment does not create an entitlement to a refund or replacement.

Where The Nurturing Nest cancels or significantly reschedules a program, workshop, or event, we will communicate the available options in accordance with our Refund & Cancellation Policy.

Nothing in these Terms or our Refund & Cancellation Policy excludes, restricts, or overrides any right or remedy that cannot lawfully be excluded under applicable consumer protection laws.

11. Intellectual Property Rights

Unless otherwise stated, all content, materials, resources, and intellectual property made available through The Nurturing Nest are owned by or licensed to The Nurturing Nest and are protected by applicable intellectual property laws.

This includes, but is not limited to:

  • The Nurturing Nest name, logo, and branding

  • Course content

  • Recorded videos

  • Live training materials

  • Coaching frameworks

  • Presentation slides

  • Worksheets

  • Journals

  • Reflection exercises

  • Digital downloads

  • PDFs

  • Workbooks

  • Retreat activities

  • Assessments

  • Templates

  • Meditation scripts

  • EFT routines

  • Visual designs

  • Graphics

  • Audio recordings

  • Mobile application content

  • Website content

  • Community resources

  • Educational methodologies

  • Program structures

  • Certification materials

  • Any future educational resources developed by The Nurturing Nest

Your purchase or participation grants you a limited, non-exclusive, non-transferable, revocable license to access and use these materials solely for your personal learning and educational purposes.

Except where expressly permitted in writing, you may not:

  • copy, reproduce, or distribute our materials;

  • record, download, or reproduce live sessions;

  • upload, publish, transmit, distribute, store, or make our Content available through public or private platforms, websites, messaging applications, cloud storage services, file-sharing services, social media, or AI training tools;

  • share course access or login credentials;

  • sell, sublicense, or commercially exploit our materials;

  • modify or create derivative works based on our content;

  • use our materials to create competing courses, workshops, coaching programs, or educational products;

  • remove copyright notices or branding from our resources.

Nothing in these Terms transfers ownership of any intellectual property to you.

All rights not expressly granted remain reserved by The Nurturing Nest.

Where we become aware of unauthorized copying, distribution, commercial use, or infringement of our intellectual property, we reserve the right to suspend access to our services and pursue any remedies available under applicable law.

12. Community Standards, Confidentiality and Participant Conduct

The Nurturing Nest is committed to creating a safe, respectful, and supportive environment where participants can learn, grow, and share openly.

By participating in any of our programs, coaching sessions, workshops, webinars, retreats, memberships, community spaces, or digital platforms, you agree to contribute positively to this environment.

We expect every participant to communicate with kindness, respect, and consideration for others, even where opinions or experiences may differ.

You agree that you will not:

  • engage in abusive, threatening, discriminatory, defamatory, or offensive behaviour;

  • harass, intimidate, or bully other participants or members of our team;

  • intentionally disrupt workshops, webinars, coaching sessions, or community discussions;

  • promote, advertise, or solicit unrelated products, services, or business opportunities without our prior written permission;

  • impersonate another participant or represent yourself falsely;

  • post unlawful, misleading, or harmful content;

  • provide medical, psychological, legal, financial, or other regulated professional advice while representing or appearing to represent The Nurturing Nest.

  • attempt to obtain confidential information belonging to other participants or The Nurturing Nest.

Many of our programs involve participants sharing personal experiences, parenting challenges, or family situations. We ask all participants to respect the privacy and confidentiality of others.

Information shared by another participant during a coaching session, workshop, membership, retreat, or community discussion should not be copied, recorded, shared, or publicly disclosed without that participant's explicit permission.

Privacy of Community Discussions

Many of our coaching sessions, workshops, memberships, retreats, and community spaces encourage participants to voluntarily share personal experiences, parenting journeys, family situations, and emotional challenges.

While we take reasonable steps to foster a respectful, supportive, and confidential community, The Nurturing Nest cannot guarantee that every participant will maintain confidentiality and is not responsible for information voluntarily shared by one participant with another, except where required by applicable law.

Participants are encouraged to exercise their own judgment when deciding what personal information they choose to share within any group environment.

The Nurturing Nest shall not be responsible for information voluntarily disclosed by one participant to another during any community interaction, except where disclosure results directly from our own negligence or a breach of our legal obligations.

Where we reasonably believe that a participant's behaviour is harmful to the learning environment or violates these Terms, The Nurturing Nest reserves the right to issue warnings, suspend participation, remove access to programs or community spaces, or terminate services without refund where appropriate.

13. Recordings and Use of Educational Content

Group webinars, workshops, courses, or educational events may be recorded where participants are informed in advance.

Private 1:1 coaching sessions will not be recorded without the participant’s prior knowledge and express consent. Where a session involving a child is proposed to be recorded, consent must be provided by the child’s parent or legal guardian.

Participants may choose not to appear on camera or may contact us before the session if they have concerns about appearing in a group recording. However, certain interactive features may be limited where participation is necessary for the program format.

Participants may not:

  • record live sessions without prior written permission;

  • distribute recordings provided by The Nurturing Nest;

  • upload recordings to social media, video-sharing platforms, messaging groups, or file-sharing services;

  • reproduce or commercially use recordings in any manner.

The Nurturing Nest retains all ownership rights in recordings created by or on behalf of The Nurturing Nest.

14. Coaching and Educational Disclaimer

The services provided by The Nurturing Nest are intended for educational, informational, and personal development purposes.

Our coaching programs, webinars, workshops, courses, retreats, digital resources, and community discussions are designed to support learning, self-awareness, emotional growth, and conscious parenting.

Our services are not intended to replace:

  • medical advice;

  • psychological therapy;

  • psychiatric treatment;

  • counselling by a licensed mental health professional;

  • legal advice;

  • financial advice; or

  • any other regulated professional service.

Any decisions you make based on information provided through our services remain your own responsibility.

While we strive to provide high-quality educational experiences and practical guidance, individual results may vary depending on personal circumstances, participation, and application of the learning.

Nothing presented through The Nurturing Nest should be interpreted as a guarantee of any specific outcome or result.

If you or your child require medical, psychological, psychiatric, or other professional support, we encourage you to seek assistance from an appropriately qualified professional.

15. Proprietary Frameworks and Educational Methodologies

The Nurturing Nest has developed and continues to develop proprietary educational frameworks, coaching methodologies, learning systems, assessments, activities, exercises, tools, program structures, and training materials for use within its services.

These may include, but are not limited to:

  • The ANCHOR Framework

  • The Mindful Motherhood Method

  • The Nurturing Nest Frameworks

  • Workshop methodologies

  • Retreat curriculum

  • Coaching models

  • Assessment tools

  • Reflection exercises

  • Journals

  • Worksheets

  • Educational templates

  • Certification systems

  • Training methodologies

  • Any future frameworks, models, systems, or educational resources developed by The Nurturing Nest.

These proprietary methodologies form part of the intellectual property of The Nurturing Nest and may not be copied, adapted, reproduced, taught, licensed, published, commercialized, or incorporated into another course, coaching program, certification, or business without our prior written permission. This restriction applies whether such use is commercial, educational, voluntary, charitable, or personal in nature.

Participation in any of our programs does not grant ownership of, or the right to commercially use, our proprietary methodologies or educational systems.

16. Certificates and Certification Programs

Where offered, The Nurturing Nest may issue certificates of participation, completion, achievement, or certification based on the requirements stated for the relevant program.

Unless expressly stated in writing, a certificate issued by The Nurturing Nest does not constitute a government-recognised academic qualification, professional licence, medical credential, mental-health qualification, or authorisation to practise a regulated profession.

Participants are responsible for confirming whether a certificate meets the requirements of any employer, institution, professional body, or regulatory authority.

We may withhold or revoke a certificate where program requirements have not been completed, information has been misrepresented, assessments have been completed dishonestly, or these Terms have been materially violated.

17. Suspension and Termination

The Nurturing Nest reserves the right to suspend, restrict, or terminate your access to any part of our website, mobile application, products, services, community platforms, or educational resources where we reasonably believe that:

  • these Terms have been violated;

  • payment obligations have not been fulfilled;

  • fraudulent, unlawful, or abusive activity has occurred;

  • intellectual property has been misused;

  • account sharing or unauthorized access has taken place;

  • your conduct is harmful to other participants or our team;

  • continued participation is likely to negatively impact the safety, integrity, or reputation of our services.

Where appropriate, we may provide notice and an opportunity to resolve the issue before suspending or terminating access. However, we reserve the right to take immediate action where necessary to protect our participants, team members, intellectual property, or business.

Termination of access does not automatically entitle a participant to any refund unless expressly provided under our Refund & Cancellation Policy.

Certain provisions of these Terms—including those relating to intellectual property, confidentiality, limitation of liability, governing law, and dispute resolution—will continue to apply even after your participation or access has ended.

18. Limitation of Liability

To the fullest extent permitted by applicable law, The Nurturing Nest, its founder, team members, facilitators, employees, contractors, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of our website, mobile application, products, services, or participation in our programs.

Our educational and coaching services are intended to support learning, awareness, and personal development. Individual experiences and outcomes may vary, and we do not guarantee any specific personal, emotional, financial, educational, parenting, or professional results.

You acknowledge that your participation in our services is voluntary and that you remain responsible for the decisions, actions, and outcomes arising from the application of the information or guidance provided.

Nothing in this section excludes or restricts liability, rights, or remedies that cannot lawfully be excluded or restricted under applicable law.

19. Changes to These Terms

As The Nurturing Nest grows and evolves, we may update these Terms from time to time to reflect changes in our services, technology, business practices, or legal requirements.

Whenever material changes are made, we will update the "Last Updated" date at the beginning of these Terms.

Where appropriate, we may also notify participants through our website, mobile application, email, or other official communication channels.

Your continued use of our website, mobile application, or services after updated Terms become effective constitutes your acceptance of those revised Terms.

20. Force Majeure

The Nurturing Nest shall not be held responsible for any delay, interruption, cancellation, or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

  • natural disasters;

  • floods;

  • earthquakes;

  • fires;

  • epidemics or pandemics;

  • government actions or restrictions;

  • war or civil unrest;

  • labour disputes;

  • internet or telecommunications failures;

  • prolonged power outages;

  • failures of third-party technology providers, hosting services, payment gateways, or communication platforms;

  • cyber incidents; or

  • any other event beyond our reasonable control.

Where reasonably possible, we will make reasonable efforts to communicate with affected participants and, where appropriate, reschedule or provide alternative arrangements.

The availability of a refund, credit, transfer, rescheduling, or alternative arrangement following a force majeure event will be determined according to the circumstances, the nature of the affected Service, costs already incurred, applicable law, and our Refund & Cancellation Policy.

21. Severability

If any provision of these Terms is determined by a court or competent authority to be invalid, illegal, or unenforceable, that provision shall be interpreted to the extent necessary to make it enforceable or, where this is not possible, shall be deemed severed from these Terms.

The remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, Refund & Cancellation Policy, Disclaimer, Cookie Policy (where applicable), and any additional written terms expressly agreed between you and The Nurturing Nest, constitute the complete agreement between you and us regarding your use of our Services.
